StampChip is a record-keeping tool. It is not tax advice, legal advice, accounting advice or financial advice, and nothing in the app, the exports, the reports or this website is. Using StampChip does not create any professional relationship with BFVZ.
You are responsible for what you enter, for keeping backups, for how you use the exports and reports, and for your tax returns. BFVZ is not responsible for whether you are audited, how an audit or any dispute with a tax authority turns out, or whether any authority, preparer or court accepts your records. Consult a licensed tax professional or attorney about your situation.
1. Who may use StampChip
You must be at least 18 years old, or older if the law where you live requires it for gambling, and legally able to enter this agreement. StampChip is designed for United States federal tax record-keeping; it may not fit other jurisdictions.
2. What StampChip is, and is not
StampChip helps you keep a diary of gambling sessions and produce exports and reports from what you entered. It performs arithmetic on your entries and applies rates and rules you configure or that were current when a version was released. It does not know your full tax situation, does not verify what you enter, and does not check that an entry is true, complete or timely.
StampChip is not: a substitute for a tax preparer, enrolled agent, CPA or attorney; a determination of what is deductible, reportable or taxable; a guarantee that any record will be accepted by the Internal Revenue Service, any state or local tax authority, any court or any other person; a casino record, a win/loss statement or a Form W-2G; or financial, investment or gambling advice of any kind. Tax law, thresholds and forms change; a version of StampChip may lag those changes.
3. Your records and your responsibility
- You are solely responsible for the accuracy, completeness and timeliness of everything you enter, and for reviewing any export or report before you rely on it or give it to anyone.
- Check-in stamps, locations and hashes are generated by your own device from its own sensors and clock. They are evidence you create; they are not certified by BFVZ or anyone else and carry no guarantee of accuracy or acceptance.
- Your diary is stored only on your device. You are responsible for making and keeping backups and for keeping your passphrase and recovery code safe. BFVZ has no copy of your diary and cannot recover a lost diary, a lost passphrase or a lost recovery code.
- How you use the exports and reports — including what you report on a return, what you give a preparer or an examiner, and what you do with the results of any audit, examination, dispute or proceeding — is your decision and your responsibility.
4. License and ownership
Subject to these terms, BFVZ grants you a personal, non-exclusive, non-transferable, revocable license to install and use StampChip on devices you own or control, for your own record-keeping. StampChip, including its code, design, text, graphics, the pin-chip mark, the name StampChip, the venue list and the report formats, is owned by BFVZ or its licensors and protected by copyright, trademark and other laws. Your diary and its contents are yours.
You may not copy, modify, translate, reverse engineer, decompile, extract, scrape, republish, sell, rent, sublicense or distribute StampChip or any part of it, build a product or service from it, remove or alter any notice, or use the StampChip name or mark, except as these terms or applicable law expressly allow. The published backup file format may be used to read your own backups.
During private testing, builds of StampChip may require an invite code. A code is personal to the tester it was issued to, works only on the number of devices we state, may not be shared or published, and may be withdrawn at any time; a test build may stop working when the test ends or when a newer build replaces it. Test builds are pre-release software and may contain defects.
5. Acceptable use
You agree not to use StampChip for anything unlawful, to create records you know to be false, to interfere with the app, the website or anyone else's use of them, to probe or attack them, or to circumvent any purchase or licensing mechanism. We may suspend or end your access if you do.
6. Purchases and refunds
The Preparer Pack and any other paid feature are sold through Google Play. Google's terms govern the purchase, billing and refunds, and BFVZ does not hold your payment details. Prices may change; the price shown at the time of purchase is the one you pay. A purchase licenses the feature for the tax year and scope stated at the time; it does not include advice or review of your records.
7. Privacy
Our privacy policy describes what StampChip stores and what, if anything, leaves your device. It is part of these terms.
8. Changes, availability and support
We may change, update, limit or discontinue StampChip or any feature at any time, with or without notice, including features that read older backups or exports. We do not promise that StampChip will be available, error-free or uninterrupted, or that defects will be fixed. Support is provided by email at hello@stampchip.com as we are able; it is not advice.
9. Disclaimer of warranties
STAMPCHIP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS, AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, BFVZ DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, DATA RETENTION AND QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. BFVZ DOES NOT WARRANT THAT STAMPCHIP OR ANY EXPORT, REPORT, CALCULATION, STAMP OR RECORD WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE OR ACCEPTED BY ANY TAX AUTHORITY, PREPARER, COURT OR OTHER PERSON, OR THAT YOUR DATA WILL NOT BE LOST, CORRUPTED OR INACCESSIBLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
10. Assumption of risk
You use StampChip at your own risk. You acknowledge that tax outcomes depend on facts, law and judgment that StampChip cannot know or assess; that records kept on a personal device can be lost; and that gambling involves financial risk that StampChip neither reduces nor advises on. You assume all risk arising from your use of StampChip and from any decision you make in reliance on it.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BFVZ AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, SAVINGS, DEDUCTIONS, REFUNDS OR GOODWILL, OR FOR ANY TAX, PENALTY, INTEREST, ASSESSMENT, AUDIT COST, PROFESSIONAL FEE, GAMBLING LOSS OR OTHER AMOUNT ARISING OUT OF OR RELATED TO STAMPCHIP, YOUR RECORDS, ANY EXPORT OR REPORT, OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY. BFVZ'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO STAMPCHIP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID BFVZ FOR STAMPCHIP IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR FIFTY US DOLLARS (US$50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE BFVZ'S LIABILITY IS LIMITED TO THE FULLEST EXTENT THE LAW ALLOWS.
12. Indemnification
You will defend, indemnify and hold harmless BFVZ and its members, managers, employees, contractors and licensors from any claim, demand, loss, liability, cost or expense (including reasonable attorneys' fees) arising out of or related to your records, your tax filings, your use of StampChip or any export or report, or your breach of these terms or of any law.
13. Termination
You may stop using StampChip at any time by uninstalling it. We may end or suspend your license if you breach these terms or if we discontinue StampChip. Sections 2 through 4 and 9 through 16 survive termination.
14. Governing law and disputes
These terms are governed by the laws of the State of Oregon and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Oregon, and you consent to their jurisdiction. Nothing here prevents either party from seeking relief in a small-claims court of competent jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
15. Google Play
If you obtained StampChip from Google Play, Google is not a party to these terms, is not responsible for StampChip, and has no obligation to provide support or maintenance for it. Google is a third-party beneficiary of these terms with respect to the license in Section 4 and may enforce it.
16. General
These terms and the privacy policy are the whole agreement between you and BFVZ about StampChip. If any part is held unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. You may not assign these terms; we may assign them to a successor. We may update these terms by posting a new version here with a new effective date; a material change will be noted in the app's release notes, and continued use after a change means you accept it.
